AfyaPonea is a healthcare navigation platform that helps users in Kenya and beyond find hospitals, doctors, and healthcare services. We provide: - A searchable directory of hospitals and healthcare providers - Price information for healthcare services (community-reported and hospital-verified) - SHA/NHIF coverage information - AI-powered symptom guidance (AfyaAI) - Hospital bill analysis (bill scanner) - Appointment booking facilitation AfyaPonea is an information and booking platform. We are not a healthcare provider, medical practice, or insurance company.

By accessing or using AfyaPonea (afyaponea.com) you agree to be bound by these Terms of Service and our Privacy Policy. These terms apply to: - Patients and members of the public using AfyaPonea to find healthcare - Doctors applying to be listed on the platform - Hospitals and clinics claiming or managing their listings - Any person accessing the website for any purpose If you are using AfyaPonea on behalf of a hospital or organisation, you represent that you have authority to bind that organisation to these terms.

IMPORTANT: AfyaAI is a health information tool, not a medical service. - AfyaAI provides general health information and guidance only - AfyaAI does NOT diagnose medical conditions - AfyaAI does NOT prescribe medication or treatment - AfyaAI is NOT a substitute for professional medical advice, diagnosis, or treatment - Always consult a qualified, registered healthcare professional for medical advice - In an emergency, call 999 or go to your nearest 24-hour hospital immediately AfyaPonea, its founders, employees, and contractors accept no liability for any medical decisions made based on AfyaAI responses. The AI is powered by Claude (Anthropic) and operates under general health information guidelines only. By using AfyaAI you acknowledge that you understand it is not a medical service and that you will seek professional medical advice for any health concerns.

Prices shown on AfyaPonea come from two sources: A) Community-reported prices — submitted by patients who have visited a hospital. These are marked "Community reported" and may be outdated or inaccurate. B) Hospital-verified prices — submitted directly by the hospital or clinic. These are marked "Verified" but may still change without notice. AfyaPonea makes no guarantee that the prices shown are current, accurate, or complete. Always confirm prices directly with the hospital before receiving treatment. AfyaPonea is not liable for any financial loss arising from reliance on prices shown on the platform.

AfyaPonea facilitates appointment requests between patients and healthcare providers. We are not a party to the appointment itself. - Submitting a booking request on AfyaPonea does not guarantee an appointment - The hospital or doctor must confirm the appointment independently - AfyaPonea is not responsible if a hospital fails to honour a booking - AfyaPonea does not currently collect payment for appointments — bookings are free - Patients should call the hospital directly to confirm their appointment if they do not receive confirmation within 24 hours AfyaPonea accepts no liability for any harm, loss, or inconvenience arising from a failed, cancelled, or incorrectly processed appointment.

A) Unclaimed listings Many hospitals on AfyaPonea are listed from publicly available information and have not been claimed by the hospital. These listings are marked "Unclaimed." The hospital has not verified or approved this information. B) Claimed and verified listings Hospitals and doctors that have gone through our verification process are marked "Verified." This means we have checked their registration and identity — it does not constitute an endorsement of the quality of their services. C) Accuracy of listings AfyaPonea makes reasonable efforts to ensure listings are accurate but cannot guarantee the accuracy of all information. If you find inaccurate information, please contact us at support@afyaponea.com. D) Right to list AfyaPonea reserves the right to list any registered healthcare facility that is publicly operating in Kenya or elsewhere. Healthcare providers who wish to correct or remove their listing may contact us.

AfyaPonea allows patients to submit reviews of hospitals and doctors. By submitting a review you agree that: - Your review is honest and based on your genuine experience - Your review does not contain false statements of fact - Your review does not contain defamatory, offensive, or discriminatory content - You are the person who actually visited the hospital or doctor being reviewed - You grant AfyaPonea a non-exclusive licence to display your review on the platform AfyaPonea reserves the right to remove any review that violates these terms or our Review Policy. We do not remove reviews simply because a hospital or doctor disagrees with them. Hospitals and doctors may flag reviews for investigation. AfyaPonea will investigate flagged reviews and remove them if they violate our policies. We will not remove genuine negative reviews.

Healthcare providers who create accounts on AfyaPonea agree to: - Provide accurate and truthful information about their facility or practice - Keep their listing information up to date, including prices and services - Not post false reviews of their own or competing facilities - Not engage in any deceptive practices on the platform - Respond to patient inquiries in a timely and professional manner - Comply with all applicable Kenyan healthcare regulations AfyaPonea reserves the right to suspend or remove any healthcare provider listing that violates these terms or that we believe poses a risk to patients.

A) Patient services Booking appointments through AfyaPonea is currently free for patients. B) Healthcare provider subscriptions Hospitals and doctors may pay for verified listings and premium features. Payment terms: - Subscription fees are charged monthly - Payment is accepted via M-Pesa - Subscriptions renew automatically unless cancelled before the renewal date - No refunds are provided for partial months - AfyaPonea reserves the right to change subscription pricing with 30 days notice - Continued use after a price change constitutes acceptance of the new price C) Payment security AfyaPonea does not store payment information. All M-Pesa transactions are processed by Safaricom. AfyaPonea is not liable for any payment processing errors by Safaricom or other payment providers.

You must not use AfyaPonea to: - Scrape, copy, or republish our data without permission - Submit false reviews or fake hospital listings - Impersonate a healthcare provider or patient - Upload malicious files or attempt to compromise our systems - Use AfyaAI to generate medical diagnoses or prescriptions for distribution - Collect personal data about other users - Send spam or unsolicited communications through our platform - Violate any applicable Kenyan or international law - Use the platform for any purpose that could harm patients or the public Violation of these prohibitions may result in immediate termination of your access and, where appropriate, referral to law enforcement.

AfyaPonea and its content are protected by copyright and other intellectual property laws. - The AfyaPonea name, logo, and brand are our property - The code, design, and structure of afyaponea.com are our property - Price data submitted by hospitals remains the property of those hospitals - Reviews submitted by patients are licensed to us as described in Section 7 - You may not reproduce, distribute, or create derivative works from our content without permission We respect the intellectual property of others. If you believe content on AfyaPonea infringes your copyright, contact us at support@afyaponea.com.

To the fullest extent permitted by Kenyan law, AfyaPonea and its operators are not liable for: - Any medical decisions made based on information found on AfyaPonea - Any harm resulting from visiting a hospital or doctor found through AfyaPonea - Any inaccuracy in price information, service listings, or hospital details - Any failure by a hospital or doctor to honour an appointment booking - Any loss of data, revenue, or profits arising from use of the platform - Any interruption or unavailability of the platform Our total liability to you for any claim arising from use of AfyaPonea shall not exceed the amount you have paid us in the 12 months preceding the claim, or KES 5,000, whichever is lower. Nothing in these terms limits our liability for death, personal injury caused by our negligence, or fraud.

You agree to indemnify and hold harmless AfyaPonea, its founders, employees, and contractors from any claims, damages, losses, or expenses (including legal fees) arising from: - Your use of AfyaPonea in violation of these terms - Content you submit to AfyaPonea (including reviews and price reports) - Your violation of any applicable law or regulation - Any claim by a third party arising from your use of the platform

AfyaPonea reserves the right to suspend or terminate your access to the platform at any time, with or without notice, if we believe you have violated these terms or pose a risk to other users or the platform. You may stop using AfyaPonea at any time. If you have a paid subscription, cancellation takes effect at the end of the current billing period. Upon termination, your right to use AfyaPonea ceases immediately. We may retain your data as described in our Privacy Policy.

We may update these terms from time to time. When we make significant changes we will: - Update the "Last updated" date at the top of this page - Post a notice on the AfyaPonea homepage - Email registered users if the changes materially affect their rights Continued use of AfyaPonea after changes are posted constitutes acceptance of the updated terms. If you do not agree to the updated terms, please stop using AfyaPonea.

These terms are governed by the laws of Kenya. Any disputes arising from these terms or your use of AfyaPonea shall be subject to the exclusive jurisdiction of the courts of Kenya. We encourage you to contact us first at support@afyaponea.com to resolve any dispute informally before pursuing legal action. We will make every reasonable effort to resolve disputes quickly and fairly.
